Policy Introduction

Business Formation is highly sensitive to the transmission and privacy interests of consumers and believes that the protection of those interests is one of its most significant responsibilities. In acknowledgment of its obligations, Business Formation has adopted the following Transmission Statement and privacy Policy applicable to information about consumers that it acquires in the course of its business:

Acquisition of Information.

We do not acquire any more information about consumers than is required by law or is otherwise necessary to provide a high level of service efficiently and securely. When Credit Card Numbers are collected, we simply pass them onto the appropriate Financial Institution. We never permanently store complete Credit Card Numbers.

Transmission of Data

All credit data is acquired under 128-Bit SSL Security and customers whose internet browsers support global 128-Bit encryption can only use our system.

Customer Sessions

All customer sessions with the secure Business Formation Merchant Servers have a 15 minute time out feature. After this time, the customer is required to reconnect to our system to re-gain access.
This does not refer to the time available to complete the forms. You may however save your data and come back to finish the form at a later date.

Our Employees and Privacy.

We train all of our employees about the importance of security and privacy. We give access to information about consumers only to those employees who require it to perform their jobs.

Security Measures.

We make access to privacy-sensitive information subject to rigourous procedural and technological controls, consistent with legal requirements and the demands of customer service.

Disclosure to Third Parties.

We will provide individually identifiable information about consumers to third parties only if we are compelled to do so by order of a duly empowered governmental authority, we have the express permission of the consumer, or it is necessary to process transactions and provide our services.

Privacy and Our Business Partners.

When we make our technology or services available to business partners, we will not share with them any more consumer information than is necessary, and we will make every reasonable effort to assure, by contract or otherwise, that they use our technology and services in a manner that is consistent with this Privacy Policy.

Security Policy

All online credit card transactions performed on this site using the PayPal secured payments.

Delivery Policy

After ordering, you will receive an email confirmation from PayPal containing your order details. We will normally confirm receipt of your order within a few minutes of ordering. We will attempt to send your goods either electronically or via Australia Post within 2 working days.

Refund Policy

If for any reason you are not completely satisfied with your purchase please email/contact us within 7 days if you are not satisfied with your purchase so that we can resolve any problems. This refund offer does not apply to goods which have been worn or used, damaged after delivery, or if any attempt has been made to alter the product. All postage and insurance costs are to be paid by the buyer.

Terms of Trading

  1. You irrevocably accept and agree the following:-
    1. Business Formation has given you no advice as to the appropriateness or suitability of you undertaking any of the services that are provided by Business Formation, whether by utilisation of the Business Formation website or by any other means. Business Formation provides the following services which include but are not limited to registration of domain names and business names.
    2. You warrant you have made your own choice in undertaking our services and having done so, instructed Business Formation to complete the required documentation to allow this decision.
    3. Business Formation prepares all documentation relating to your instructions. Business Formation is not and does not purport to be an accountant, solicitor, or legal firm and it is not a financial planner.
    4. Business Formation does not give nor claim to give legal, financial or accounting advice (including but not limited to advice on taxation law or stamp duty law).
    5. Business Formation will use its best endeavours to explain all relevant matters and instructions to you clearly, you may, however, misinterpret such explanations and/or instructions or you may omit to read all instructions. Business Formation is not liable in any respect for any such misinterpretation or omissions.
    6. Business Formation has made no statement to you that any service provided by Business Formation will be available to you by any specific date. If you require any Business Formation services by a particular time or date, you should not be using Business Formation.
    7. You have either received your own independent professional advice OR you have made your own deliberate decision not to obtain the relevant advice and you accept any risks of having done so.
    8. All and any information and content and intellectual property that is displayed on the Business Formation website (except any information, content and intellectual property which is displayed as a result of a hyperlink to another website or a non- Business Formation web page), any programming and/or code is and remains the property of Business Formation. You agree not to make any copies or use such property code and programming except for the purpose of using a Business Formation service or considering using a Business Formation service.
    9. The most that you are able to recover from Business Formation under any circumstances and irrespective of any fault of Business Formation, is the fee charged by Business Formation to you.
    10. Business Formation is not liable to you or any other third party for any loss or damage including but not limited to any consequential economic loss or damage which may be suffered by you or a third party or may arise either directly or indirectly out of any use by you of any of the services provided by Business Formation.
  2. Payment of all fees due to Business Formation or any Australian or State Government or any other body authorised to collect fees for completion of the service, is required prior to completion of the service.
  3. Any provisions of these Terms and Conditions which are void, voidable or unenforceable should be excised from these Terms and Conditions and the balance of these Terms and Conditions shall remain of full force and effect. These Terms and Conditions shall be governed by the laws of Victoria, Australia.
  4. You submit to the non-exclusive jurisdiction of the Supreme Court of Victoria in relation to any dispute arising under this agreement.
  5. You agree that you shall not nor attempt to copy, duplicate or adapt, significantly copy, duplicate or adapt, or partially copy, duplicate or adapt this website, its essential concepts, its contents, its design, logos or logic, its order, its method of activating and displaying guidance, its method of generating and downloading documents, its interface or any general code or codes, or any of its selections or any other of questions, optional answers, facts or information, any ideas, guidance or expressions.
  6. These Terms and Conditions cover the entire understanding and agreement between you and Business Formation with respect to any of your use of Business Formation’s services.
  7. You agree that you have obtained all necessary consents from any third party in relation to any of the services provided by Business Formation.
