If you plan to do business (trade) then it is generally recommended that you will need a business name (BRN - Business Registration Number), an Australian Business Number (ABN) and register for GST. Business Formation recommends that you consult your accountant or lawyer if you are uncertain or confused by your legal requirements.

Most businesses as well as fulfilling the the above formality would like to acquire a domain name, an individual email address or addresses that match their business name as well as a web presence. Business formation has been established to make that process user friendly and as helpful as possible.

Business Name Registrations

Who should register:

If you are unsure of your requirement to register a business name we recommend that you consult your accountant or lawyer.

Business Formation will prepare the documents to meet the requirements of the respective State body for the requisition of a business registration number (BRN). All state and Territories with the exception of Victoria and South Australia require a signature on the application form. Consequently it is a requirement that we send the prepared application forms to you for signing and forwarding to the relevant state bodies for approval. For this reason we do not include in our fees for State Government charges. In the case of Victoria and South Australia we can, if you request it, complete the application. In these cases we will include the Government charges.

Prepared documents can either be emailed (in PDF Format) or posted to you via Australia Post depending on the delivery method chosen at the time of order.

Once you have your certificate of registration of a business name, Business Formation can arrange for registration with the Australian Taxation Office for a TFN, GST, and PAYG. (see ATO Registration)

Australian Tax Office Registrations

 Australian Tax Office Registrations Individual: If you are an individual, or sole trader such as a sub-contractor or a single tradesperson you should complete the ATO Registration Individual order form

 Australian Tax Office Registrations Business: If you are registering on behalf of a company or a business partnership then you should complete the ATO Registration Business application form.

Business Formation will will provide assistance in registering with the Australian Taxation Office for:

1. An Australian Business Number (ABN)
The ABN is a unique 11 digit identifying number that businesses use when dealing with other businesses. For example, you generally need to put your ABN on your invoices, or other documents relating to sales that you make. If you don’t, other businesses may withhold 46.5% from any payment to you.

You also need an ABN in certain dealings with the Tax Office and other areas of government.

Registering for an ABN is not compulsory, but you will need one to register for the GST. Your ABN allows you to:

2. Goods and Services Tax (GST)
If your business has a GST turnover of $75,000 or more (or $150,000 or more for not-for-profit entities) you must register for GST and you’ll need an ABN to do this. If your business has a lower GST turnover, it’s up to you whether you register.

3. Pay As You Go tax (PAYG)
Generally if you have employees you need to register for PAYG.

If you buy supplies or services from a business that does not quote an ABN when you come to make payment if it is more than $75 excluding any GST, you will have to withhold 46.5 per cent of the payment and pay it to the Tax Office. You will need to be registered under the PAYG withholding system for payment to the Tax office.

Internet Domain Name Registration

Business Formation will register a domain name of your choosing for a period of 2 years. The process of registration is ongoing and the registration will need to be renewed every 2 years. The registration however does not enable you to use it but simply makes the name available to you for use for the registration period. To use the domain for email and a web page then the domain name will require to be hosted. See the next section.

A domain name consists of two parts. For example "yourdomain.com.au" consists of a name that you wish to allocate to your business (yourname) and what is termed "top-level domain" (.com.au or .com). Business Formation can register your domain name with various top-level domain suffixes such as .com, .com.au, .co.nz, .net.au, .org.au etc. The .com usually means commerce, and .net networks, and .org organisations which would be charitable, non-profit or sporting organisations. The .au means Australia and .nz New Zealand. This is not the limit of what is offered but a simplistic explanation of some of the registration types. Generally if you were only operating in Australia you would register a ".au" domain but if you were planning a wider distribution you may prefer a ".com" domain. The "yourname" part that you choose should have some relevance to your business such as part of your business name or an acronym or abbreviation of it or substantially connected to the business.

A domain name can consist of any alphabet characters (a to z), a hyphen (-) and numbers (0 to 9) and is limited to 64 characters including the extension (.com.au). A domain name is case insensitive.

Internet Domain Name Hosting

If you have a domain name and you want to use it for email or to have a web page you will need to host your domain. Business Formation can arrange this for you. There are various plan options available to you but we suggest that unless you know your requirements it is better to start with a plan that meets your email requirements and upgrade at a later date. Coupon System

From time to time Business Formation may have various promotions that offer a benefit for using our services via a coupon system. We also offer this facility to various clubs and charity groups. A coupon number can be entered at the final stage of the order system should you have one to attain your benefit. Delivery Methods

Most of the services that we offer can be finalised by Business Formation and you will be notified accordingly.

A notable exception to this is the Business Name Registration where all State Governments and Territories with the exception of Victoria require your signature on the form. In such cases we prepare the documents for you and send to your for your signature. It will be your responsibility to forward the signed for to the relevant authority with the appropriate fee.

Payment Methods

Business Formation uses PayPal payment gateway for payment of invoices by either your PayPal account or using a credit card. This is a secure payment system and Business Formation never sees nor saves your credit card details. PayPal offer a dispute resolution process should you become dissatisfied with our service or our refund policy. See our Terms and Conditions page.
